May 2009: In Ontario, Rohan Abbey is accused of raping a woman known only as C.P. The police are not interested, so she tries a private prosecution; the Crown will have none of it. He decides enough is enough, and sues her for both defamation and malicious prosecution. The court was not impressed with her defence, Mr Abbey won the case by a country mile, although he was awarded only $10,000 damages and $4,000 costs, but at the time this was the maximum the small claims court could award.
If you read this judgment, you will understand why the court was so unimpressed with her, not only did she in effect invite him to rape her again (after the first and only phantom rape) but she attempted to suborn perjury. One might ask not only why this woman was not stripped of her anonymity but why she didn’t face criminal charges herself.
