This American military case is absolutely mind-blowing. The reality was that she’d had consensual sex with a man she’d just met – as any nice girl would do. Not. She told the police the guy had ripped her knickers, and they become an exhibit.
The police carry out a thorough investigation, upon which she admits the sex was consensual, and withdraws her allegation. But, two years earlier she had been raped by Albert Stellon in broadly similar circumstances complete with torn underwear. Stellon had claimed initially the sex was consensual but would shortly admit he raped her. For whatever reason, his trial was delayed until 2005, and this false rape allegation having come to light, he tried to use it to discredit her, and failed. His conviction was upheld on appeal. It does though make you wonder if Stellon was really guilty – think Brian Banks and the sentence Stellon might have received had he gone to trial and been convicted then.
This quote from the second page of the above judgment is mind-blowing:
“I realized [after the fact] I didn’t want it [the intercourse in the car] to happen.”
